An #appellate #court issued a #secret opinion Friday in a case filed by Mashour Abdullah Alsabri, a Yemeni national who seeks release from Guantanamo Bay.
The decision by a three-judge panel of the D.C. Circuit Court of Appeals upholds a trial court decision in 2010 denying Mr. Alsabri's habeas corpus petition. As the trial court concluded:
'The government has established by a preponderance of the evidence that the petitioner traveled from Yemen to Afghanistan in 2000 to fight with the Taliban, al-Qaida or associated forces, stayed in Taliban and al-Qaida guesthouses, sought out and received military-style training from the Taliba n or al-Qaida, traveled to the battle lines in Afghanistan as part of the Taliban or al-Qaida and remainedpart ofthose forces at the time of his capture in early 2002."
